Question:
Can a Gov.State/City select not to include Gastric by-pass?
The Public School System choice not to select riders allowing for Fertility options and for Gastric-by-pass in their selection of Insurers for 2003. This seems in non-compliance with the American Disabilities Act and discriminates against overweight people. Isn't this against the law or should be. To whom do we report discrimination. — Nancy T. Sorry, but obesity is not necessarily considered a disability that
restricts a life function as is required by the ADA, therefore, the
employer has the right to chose what options are to be included in an
insurance plan. They are not being discriminatory in what they are
providing, because they are providing the same thing to all employees. If
they included these options in their plan, and then pointed to an
individual and said "you can't be covered under this plan because you
are obese", then it would be discrimination.

It is not against the law to discriminate against an Obese person. Where
does it fall into gender,race,and age?Being Obese is not recoginized.
We are out of luck until we stand together and write our dear elected ones.
