Can a Gov.State/City select not to include Gastric by-pass?

The Public School System choice not to select riders allowing for Fertility options and for Gastric-by-pass in their selection of Insurers for 2003. This seems in non-compliance with the American Disabilities Act and discriminates against overweight people. Isn't this against the law or should be. To whom do we report discrimination.
