Question:
I had surgery way back in '94. Due to complications, I have questions.

The doctor who did my surgery, told me he was unable to complete my bypass (rny)). He Lied. He did it, but badly, it has consequently caused problems for many years, i had assumed the problems were due to adhesions but that was not the case. Recently, I had a colonoscopy and EDG, only to fine out that I did have the bypass only done incorrectly. I never considered a lawsuit, but now my insurer refused to cover a revision. Has anyone ever had a problem like this before...what avenues did you pursue? I really don't want money for compensation..would just like to be put together correctly! Thanks    — Teresa W. You should contact a lawyer immediately -- in most jurisdictions, your discovery of the malpractice/mistake starts a statute of limitations on filing suit that may be as short as a year.

Teresa, It sound to me, that you should be able to fight your Ins. company decision on a revision. You must find a competent Dr. to start & then do what he tells you about the revision. Where do you live? It would be worth your money & effort to Get to Las Vegas & see Dr. Fisher. He is the best in the business & can tell you how to get your problem repaired. I personally think you should gather all your medical evidence that this was done incorrectly, and the medical records from his office, stating why he said he could not complete the surgery, and go and have a free consultation with a malpractice attorney. This is not about compensation this is about your health. How do you know that this messed up surgery won't cause you life threatening complications down the road? What happened to you is wrong, and you should at least try and get the surgeon to pay for someone who is competent to fix you. Don't allow your insurance to persuade you into doing nothing. What you have is a malpractice issue not a revision issue. You do not need a revision, that is for surgeries that were done right, but the pouch expanded. You need a total reconstruction, to fix what a incompetent did. I hope everyting goes the right way for you. I will pray that it will, God Bless you.

Get a copy of your operative report from the old surgeon a copy of the EGD and colonoscopy reports and then take them to a different bariatric surgeon and see what he thinks. See if he can fix you up. I would also contact a lawyer if you feel that the old surgeon lied to you about the previous surgery and if it was put together wrong.
