Question:
Isn't exclusion of obesity surgery coverage an act of discrimination by insurers?
Are we not covered by the Americans with Disabilities Act in such cases? It seems that insurers that exclude obesity surgery while covering other types of surgery are discriminating. Has anyone explored this, and with what outcome? Thank you. — [Anonymous] (posted on November 9, 2000)

To Donna Brandt- Perhaps you misunderstood the question. I am not referring
to refusal of insurance coverage. I am referring to exclusion of obesity
surgery by an insurer that covers other types of surgery. I am already
covered by the insurer- have been for four years. Thank you.

Well I just gave up my fight with the ins companies...I am now self pay
with a date of Jan 30th...basically I tried everything everyone
suggested...sent 15 page initial letter signed by PCP(to both my ins
companies, I have double coverage), sent appeals...flat out "NO"
on all...Since my husband handles the benefits for all his employees and
three of their employees are obese...tried to change to any ins company in
our state that would handle WLS..there was road blocks every where they
turned..so they gave up...tried to say I lived out of state..didn't
work..talked to Lingstrom..no way with our state.etc.etc.etc....at a point
you need to move on and get the surgery done..I know at some point all our
fighting is going to help others but I can't sit around and wait any
longer...good luck.
