Isn't exclusion of obesity surgery coverage an act of discrimination by insurers?

Are we not covered by the Americans with Disabilities Act in such cases? It seems that insurers that exclude obesity surgery while covering other types of surgery are discriminating. Has anyone explored this, and with what outcome? Thank you.
