Question:
approved with BCBS but had to change INS now was denied
I was approved with BCBS on 7/29 but had to change INS due to my hubby's employers changing INS companies to Humana and now was denied 8/26. I will apperal but isn't there a law that states they have to accept the decision and work with the 1st INS company. I tried to continue with BCBS on my own but due to my weight they can not even write a policy for me. 280lbs this is tough. — abby13079 (posted on September 2, 2003)

I believe the law you're referring to is the HIPPA. This law says
basically that if you had coverage for the last 18mos without a break (I
think it's a break greater than 60 or 90 days) you can't be denied
insurance because of a pre existing condition. I would contact BCBS and
tell them they have to write you your own policy because of that. That way
you won't have to start the approval process all over again. You should
also contact your local insurance commission (sp). Hope this helps.

Id like to hear from an insurance person on this. I had bcbs and my
"approval" was only good if I still had bcbs on the day of the
surgery. If you are no longer covered by bcbs I cant imagine that they will
pay. I would work w/ humana, as I know people who have had surgery paid for
by humana. I know tho every policy is different and yours may be different
than the one Where I work. First I owuld see if wls is a cvered benefit
under your policy. If yes, then I would find out what exactly they want rom
you in order to qualify you to pay. the insurance portibility law HIPPA to
my understanding requires that a new company insure you as long as you have
been continually covered, but would not require a company you are no longer
insured by to pay for surgery. Good LUCK!
