Question:
If you work for the gvmt. are (we) exempt from filing under ERISA LAW
I work for a school dist. I have ( self insured state govt.) I have been denied surgery ( exclusion) The website for ERISA says church/ govt. do not have to comply w/ this law. Does anyone have experience with this? — Cindee A. (posted on May 2, 2001)

In addition.. what is your exclusion and what did your denial state. I
think you should appeal and appeal and appeal.. then you can take it to
your employer and ask them to make and exception and remove your exclusion
as its discriminatory. Email if I can help. Dawn.

The Federal Register will have the most updated law on this. The law
changed for the first time in 20 year in 1999 giving insureds under
self-insured plans more rights. Go to www.dol.gov and follow the links to
the press release dated November 2000. I must tell you, however, after
discussing my denials of reconstructive plastic surgery with my regional
DoL office, they told me to request in writing the specific reasons under
the plan, but if that got me nowhere an attorney is my next step. So, it's
surgical fees vs. legal fees...
