Question:
Looking for an aggressive attorney
Does anyone know of a aggressive attorney who would take a medical malpractice case? I had to have my band removed because of incompetent doctors here in Utah, and no attorneys here will help me because my surgeon was in mexico. Even though every attorney I have contacted said that I defiantly had a case but because It included a surgeon out of the country they wouldn't take the case. The problem wasn't with the surgeon in Mexico, it was the dr's here in utah. Any info will help. My story is on my bio. I have Kaiser insurance in southern CA. They approve the RNY here, but not
the lap band. Lap bands have a higher failure rate, for a variety of
reasons than RNY surgery. I don't know why you had problems, but having
surgery out of the US can lead to problems, like you are facing now.

My Dr. here in Texas wont even do follow up care on someone who had their
band or rny in Mexico. Maybe that's why layers don't want to touch it. I'm
sure it would get complicated really quickly. I'm sorry for your problems
and I'll keep you in my prayers. My brother in law is Personal Injury
lawyer in Florida. I'll try to pick his brain for you.

If you want your band back then you can't be tring to sue a Doctor for
malpractice. No Doctor will go do anything for you. When u get the band you
signed a form so if anything or what happen to you you can't sue. If you
had this done in Mex then what did the Doctor do in Utah? Because you had
problums with the band maybe you should do the Gastric bypass. Hope
everything works out for you.

I'm read your profile and I am very sorry to read what you have been
through. It sounds absolutely awful.
I have had a lot of trouble with my local ER... I had appendicitis and
went to the ER with the classic symptoms and was sent home three times
without labwork or any diagnostic studies. They kept telling me it was a
urinary tract infection!! Because of the delay, I had surgical
complications and was very sick and miserable in the hospital for 10 days
(most people are discharged after 24 hours). I was so debilitated after I
was released that my mother had to fly in from out of state and move me to
a relative's house for a month until I was able to care for myself. Family
and friends were on me to go after the doctors/hospital legally (tho I just
wanted to forget about it and move on) so I made some calls to a couple
local attorneys.
Sounds like a pretty obvious malpractice case, right?
NOPE. In order to be successful in these type of cases, a person has to
have significant permanent injury or death. Of course, if I was willing to
pay them upfront, they'd take my case but told me I'd be wasting my money.
I don't really understand what having a non-US surgeon has to do with
anything, unless the doctors that treated you found some way to turn things
around and blame him for the problems you had when you showed up in the ER.
