Question:
How is it discriminitory to deny us WLS
If we have a self insured policy, which has an exclusion for morbid obesity, how is it still disriminitory to deny us WLS? I'm just gathering amunition for my fight. — K T. (posted on May 2, 2001)

From my understanding, and I don't know everything by any means, it is
discriminatory to refuse coverage for a certain "group" of people
based on their disability. For instance, you wouldn't discriminate against
someone because they have cancer, multiple sclerosis, arthritis, etc...
For further information on this subject look under the American Disability
Act. Also, if this insurance is through your employer you might want to
appeal to them by including a letter from your surgeon stating this is a
matter of life and death (because it is). Your employer won't want to be
held responsible should something happen to you as a result of obesity when
this surgery could have prevented it. Know what I mean? Keep your head up
and don't give up the fight! Pursue every avenue you have available. Good
luck to you and if I can offer any assistance at all please let me know and
I'll help all I can. We're all in this together!
