Question:
Can I be denied Short Term Dissability?
Sun Healthcare has denied my STD because they state it was not a "medical condition" and elective surgery. I'm wondering if there are any other people that have undergone this. This sounds mighty ODD to me, but I am not an expert in this area.
However, it is my understanding that short term disability pay is for times
when you are unable to perform any aspects of your job because of a health
condition. I don't think "elective" or "non elective"
should play into this at all. If you were playing baseball and hurt your
back rendering you unable to sit at your desk, you would be eligible for
short term disability. If you were going through a divorce and this was
causing you emotional distress (not being able to sleep, not being able to
concentrate) you would be eligible for short term disability. Having a
baby is elective(usually)! Is that not covered under your short-term
disabily program? Certainly recovery from (ANY) surgery should make you
eligible for short term disability pay--you will tire easily and be unable
to sit, stand or walk for long periods of time. I know at my company
elective or non-elective does not come into play. If you are unable to
perform some aspect of your job...then short term disability is there to
cover until you recover. ASK MORE QUESTIONS!

I am currrently on STD - had my surgery 12/28. I did not tell my HR dept.
exactly what I was having done, it's none of their business. All that
matters is that you qualify for STD (been with the company long enough).
You had the surgery & are unable to work for a period of time - doesn't
matter what the surgery was for. Don't back down!
