Question:
I live in VA, but my insurance Co. is based out of Ohio...
Do the VA state laws apply, even though they are not based out of VA? — Sarah P. (posted on April 9, 2002)

I would look up the actual law. I know the Md law states taht any
insurance company providing services in the state of MD must approve the
surgery if its deemed medically necessary

Hi, I had BCBS of CA but live in Mississippi. BCBS of MS does NOT approve
this surgery but....BCBS of CA does and I was approved immediately. What
does this have to do with you?LOL Maybe nothing but I just thought I would
tell you that others have been in this position. My insurance went with
where the insurance was issued. Good luck

This sounds like one of those questions where the answers may differ from
state to state. Call your state's insurance division, or commission, or
department (that also differs from one state to th next) and find out.

It dosen't matter where the insurance company is located, only where you
are. The laws of Virgina regarding weight loss surgery protect you.
Therefore, your insurance co. has to allow your surgery even though they
are based in another state if you meet medical necessity requirements as
set forth by Va. law.

Insurance companies must follow all the laws pertaining to the state that
you live in.
