I am still dealing with NYLCare in Virginia. I applied for the surgery around January, and they denied me in late February (two days before surgery). I paid cash for the surgery, and am in the appeal process now. I would seriously urge you to contact them for the list of items needed for approval. I did not get one the first time I applied, and they never told me I needed certain things before denying me. Have proof of your diet history, including photos, cancelled checks, whatever. Document your failure to keep the weight off. Have medical proof of your need for surgery from a doctor. Have a psychiatric exam (to ensure you aren't doing the surgery for the wrong reason). They will want you to have participated in a nutritional/behavior modification program, including exercise, etc. Just ask for the criteria, and hopefully they will send it to you!
