Question:
A friend told me that there was some sort of insurance law or decision made recently

She said that anyone 100 pounds or more have to be accepted for WLS. Has anyone else heard about this, or is she nuts?    — Anita A. (posted on August 15, 2002)

I live in Maryland, and we have a WLS Law. The Law says that the insurance company has to offer WLS in their policies, but, they do have the option of denying coverage if a person doesn't meet all of the requirements.

it varies by state and it also depends on whether your insurance is fully funded or self-funded. Self-funded plans do not have to adhere to mandates, like fully funded. In any event, most health insurance carriers do accept WLS as the only means to treat morbid obesity, since this in accordance with NIH standards. The 100 pounds or high BMI are the standards most carriers use to determine if WLS will be covered.
