are there any laws aabout insurance companies having to treat this as a disase

Unfortunately, to my knowledge, there are no laws on the books saying that
obesity or morbid obesity are classed as diseases which must be addressed
by insurance companies. However, the NIH DOES recognize obesity and morbid
obesity as diseases, diseases they say that are at epidemic proportions
(64% of Americans are overweight or larger). There are people working to
get laws passed classifying morbid obesity, with the standard definition of
35 BMI with one or more co-morbidities or 40 BMI or greater with or without
co-morbidities, as a disease that insurance companies must cover treatment
for, but as far as I know, nothing has yet been made into law.

The laws about insurance coverage are made by state government, not the
federal government. Some states do have laws about covering the surgery,
but most do not. I wish I knew which states do have laws, but it's been a
long time since I read anything about that. You might try calling your
state's insurance commission or insurance office and see what they say.
