Question:
I need a obestiy lawyer in Texas to help me fight my insurance company!
My mom is going down hill very quickly!!! I am obese as well, I can pay out of pocket for my surgery but my mother cannot afford too. She has high blood pressure, high cholesterol, sleep apnea, she has to wear oxygen, her hips ankles and feet are giving out on her, she is on depreesion meds, arthritis everywhere pretty much, and so much more!!!! She has a BMI of 72 . We have been to 4 different doctors and none can help us because my fathers insurance that covers her excludes the treatment even if it does better her health or is deemed medically necessary! Needless to say we are at a dead end road and mom is not going to last much longer!!! She has always been a go getter and her weight never really stopped her before but the past 5 to 6 years it has become a nusense and she cannot go on like this!!!! — natrobins (posted on May 7, 2008)

oh wow. I'm sorry you and your Mom is going through this. I don't live in
Texas. The only thing I know of to recommend would be to contact a local
lawyer and ask if they would handle something like this and if not, ask if
they can recommend someone who can. Good luck. I hope your mom does better!

I live in Texas and my suggestion for you is to contact the State Bar
Association for them to give you a name of a good attorney who could
help...there is also Lawyer Referral Services and then appeal to the State
Board of Insurance with your complaint explain to them just like you did
here. Usually a Insurance company you can appeal due to MEDICAL NECESSARY
there is some that will give in without the fuss. Good Luck

Try www.obesitylaw.com. I have heard they have been very successful in
getting surgeries approved on appeals. I'm not sure if they can do it if
WLS is a Plan Exclusion. I had BCBS Florida at the time of my surgery and
I was a self pay as it was an exclusion. $18,500 to be exact. Good luck.
There are also medical credit cards that can be gotten for surgery as
well.

The best Obesity Attorney is one that was overweight and had to figth the
system himself. I live in Florida and dealt with www.Obesitylaw.com in
Califorina. WALTER LINDSTROM, JR. is the attorney that head the operation
and his wife is also an attorney there. He had surgery and just spelizes
in insurance cases for Obeisty. He know the companys well and he will tell
you if there is a clause in your policy that is a drop dead issue where
they will not do bariatric surgery because it is eliminated in the policy.
The first call after your email to him from his web site is free. His
charges are usually around $500.00, but no charge if you have limites in
your policy that he can not figt and win. I spewnt 6000.00 with a Florida
attorney and not a dime with him, but he and his wife spent a few hours
checking my policy. He can also tell you the surgeron that will work with
him in detailing your mothers case from the medical side. Best of success
to you.

Hello,
I was wondering if you had any type of insurance. If you can be covered
than maybe you could help save your moms life by heping her pay. Just a
thought. Insurance carriers a such a tremendous pain. I am in Connecticut
and my doctor somehow had gotten medicare and state to assist with mine.
Talk to the doctor as well. My doctor wanted to help me so much that he was
willing to write it off as a loss if he had too.
I am sure the doctor could afford to eat some of the cost.
I wish the best to you and your mom. May god bless you at this time and
always and may he find a way for both you and your mom to behelped with
your life saving surgery.

I see that most of the answers that you have recieved is good. The same
that I would have suggested. I just want you and your family to know that I
am keeping this whole situation in my prayers. Also in my prayers are your
mom and your family. I pray that everything turns out good. Keep fighting
the good fight and God bless you for being your mom's advocate when she is
unable to be her own.

Natalie,
Has your mom thought about seeing an MD in Mexico. I have heard of people
going to Mexico for surgery. It is much cheaper there I have heard. I was
lucky enough to have insurance to pay for mine. I know that without my
insurance, I would have been dead by now. Do you live in Corsicana? I think
your mom used to babysit my nephew, Keith. Jane.

Oh my the best Obesity Attorney ever is with www.Obesitylaw.com in
Califorina. Walter Lindstrom and his wife is the best. I had to appeal and
my Doctors office helped me get in touch with him and he took my case and
WON!! I live in Indiana and I would recommend him to anyone. Good Luck to
you and your mother. Let me know how it goes.

Some people posted to check out W. Lindstrom so that may be a good bet. I
would NOT recommend Viscio. EVER. You can win this however. After my
crappy experience with Viscio, we got a local attorney and won my case. I
would look into a local attorney in Texas, not someone online.
