Question:
Anyone about to lose these jobs because of compliactions?
My son is about to lose his job because of complications with surgery. Any ideas out there? — sextonglenda (posted on September 18, 2007)

Mrs. Sexton, is your son eligible for FMLA? If so, part of the purpose of
FMLA (family leave medical act) is to protect one's job while they are
taking care of medical issues, etc. -- their own medical issues, as well as
immediate family medical issues.

He can always take a medical leave of absence for a couple of months, or
even 1 month. If he is having complications due to the surgery get the
doctor to write him out of work ASAP so he does not lose his job. I took a
2 month leave for just the surgery part. Of course I lived on what I had
saved and then had to borrow afterwards because no work, no income.

My son has only been able to work one full week since his surgery on May 2
of this year. Human resources is giving him a hard time. he is very
depressed and this only makes it worse. he has not been able to walk for
three weeks now.(neuropathy in his legs) He is coming along but it will
take time. He did take two steps today. We were grateful for that.

I am 13 months post op. I had surgery 8-9 of last year, well my first of
many. I was out of work for 3 months due to complications and I recieved
Temporary Disibility. It actually might back pay from like the first week
after missing work. Check out my profile to read what happened if yor

As the first poster stated, check into FMLA (family medical leave act).
From my understanding, his work CANNOT fire him, let him go etc during this
time! If so, he could sue them. Double check on this to make sure. Good

FMLA is a wonderful thing but, I think it may be limited to 12 weeks a
year. Look into that and I pray I am wrong (don't know if every state has a
different limit). He may also want to see what his employer has as far as a
medical leave of absence. This in many companies is 6 mos to a year, but
unpaid. Perhaps if he takes that leave he can file for state assistance
during that time. I feel for him as I too was sick for about 4-5 mos one
time(not related to my WLS). God bless and good luck!

Hi. My occupation is an employment services rep. FMLA is an answer for your
son if the company he works for meets the FMLA mandated requirements. If a
company has at least 50 employees they must allow for FMLA. Now that 50
employees can be within a region of 45 miles or less, provided that all
locations are owned by the same owner. Also, one of the post is correct
that 12 weeks are offered. The company has the liberty to set the fiscal
year by what ever they use. (ie: Oct to Sept, Jul to June and ect). Keep in
mind that any sick, personal, and vacation time must also be used toward
that 12 weeks.
The statement that the employer cannot fire him could be untrue. If the
state is a right to work state, the company can fire anyone with no reason!
Ohio is one of these such states. (Keep in mind, that they may be able to
file for unemployment though, because the employer has to show just cause.)
As you can tell, I work for the state gov't. Hope this helps.
