Question:
Is Morbid Obesity a legal disability?

I was getting information on applying for SSI and Vocational Rehab and I didn't see it listed as an actual disability, just the side effects of it. I think it may be the only way to pay for my surgery, since I am currently umemployed. Will it matter if I am going through bankruptcy right now? Or that my truck was recently reposssed? Or that I had to move back home with my parents? We have had a few patients that were on disability because of their weight. However, they were genuinely completely disabled as a result of it. All were in wheelchairs or scooters and had vastly limited ambulation. I, in no way, am making light of your situation. I completely understand the pain and misery of being obese. However, using our patient base as a rule - I've never seen anyone your size and age that was considered disabled. Still, it couldn't hurt to try. As far as the bankruptcy and repossession - that doesn't have any bearing on disability status. Don't give up! You'll figure out a way. Best wishes to you.

Because of your age you would have an extremely difficult time getting SSI. Do you have other medical problems besides those caused by obesity? You would be eligible for Medicare eventually with SSI but most surgeons are not even taking it anymore. You may also see if you are eligible for Medicaid but I would assume surgeons shy away from that as well. Since you seem to be going through a really tough time at the moment you may be clinically depressed and that could be a diagnosis that would be acceptable to Social Security. They will send you to doctor's of their choosing to confirm any and all claims. Best of luck to you.

Heidi, What you going through I totally understand, For the past 6 months I called in sick to my job and haven't been back(with 19yrs and making 50k). I was told by my doctor's I was suffering from bi-polar and major depressed. I also lost everything too and had to depend on my mother to support me(I'm 37). I applied for SSI (texas) and i was denied and I have every health condition wrong me ( high-blood pressure,diabetes, sleep apnea, mental problems) and with all that i was still denied. I don't know what state you are in because every state is different. By my doctor's taken my off work, I still have my medical insurance and I'm able to have my surgery. So good luck on your journey.
