Question:
Can morbid obesity be considered a disability?
And if obesity IS considered a disability and an insurance says it's denied due to a notorious "written exclusion" policy could that denial be considered discrimination? — K D. (posted on August 1, 2001)

My understanding is that morbid obesity is a clinical diagnosis;
but, it isn't considered a disability. Many people are morbidly
obese and not sick or physically impaired at all.

I asked this question not long ago. You will find a very good answer in the

i dont know if morbid obesity in itself is a disability but, i have been
found to be disabled by my employer due to some of my CO-morbids. i will
soon find out if social security is going to classify me disabled due to
these same co-morbids.

Under the social security disability act in the state of Oklahoma,
"morbid obesity" was illiminated from the list of disabilites,
however; if you have other impending medical conditions because of your
morbid obesity, you CAN in fact be found disabled. I am living proof of

I LIVE IN INDIANA AND MY LAWYER SAYS THAT MORBID OBESITY IS A DISABILITY
DUE TO THE CO MORBIDITIES YOU HAVE ALONG WITH IT LIKE NOT BEING ABLE TO
CLEAN YOURSELF AFTER USING RESTROOM, SHOWER, NOT BEING ABLE TO WALK FAR,
GETTING OUT OF BREATH, DIABETIES, SWELLING IN FEET, ANKLES, LEGS, ECT THERE
ARE A LOT OF THINGS WHEN YOU OBESE THAT CAN CAUSE YOUTO BE DISABLILED. I
WOULD FIND A LAWYER THAN DOESNT CHARGE OR LESS YOU WIN AND GET AN OPION
FROM THEM. IT CANT HURT. GOOD LUCK.
