Question:
has anyone had the surgery thru there insurance with bmi >40 with sleep apnea?

I was approved by my insurance company with a BMI of 39.2. I had mild sleep
apnea, high cholestrol, arthritis, high blood pressure and diabetes, but
did not yet require medication for these as they were just developing for
me.

I assume that you mean < (less than) 40 BMI. Many insurance will cover
with a BMI of 35-40 with co-morbidities (including sleep apnea). If you
are very much under BMI of 35, you might have more trouble, but that's not
to say it's impossible. The best thing to do is to read your policy
carefully and see what their requirements are (many are very specific) and
if in doubt, call and ask them.
