Question:
Does worker's Comp paying for WLS?
My husb has had 3 back surgeries in the last year and has gained about 120 lbs due to being bedridden so long. I personally had surgery in March and it has helped me tremendously. The doctor has recommended that the insurance pay for a "weight loss program" for my husband. Does anyone know of any individual on worker's comp or a company injury who has had WLS? Thank you so much for your help! — Jennifer C (posted on August 3, 2002)

It's extremely hard to get Workers Comp to pay for anything but your
husband could try to file a C-2 stating that his weight gain was caused by
his back injury and see if the claim is approved. I would be fascinated to
know if it is or not. I have a friend who gained a tremendous amount of
weight after his injury and maybe he could do it too. Anyway, the worst
they can do is say no so might as well give it a try. Good luck! :)

I work for a large wc carrier in the state of md, and yes you can get WC to
pay for this procedure. However, it is difficult. Very difficult. Most
commonly the procedure will be paid for if it is causing a delay in the
claim status by not allowing the claimant to return to what they call MMI
(maximum medical improvement) alot of times the weight needs to come off
PRIOR to getting back surgery and if that is the case it is easier to get
the approval. WC laws vary in each state greatly, I would call the
workers' compensation commissioners office in your state and inquire. Good
luck, Stacy
