Question:
I have a question regarding Wills....
Ok I looked in the library under wills. I understand that a living will is something I will complete at the hospital. But what about a regular will? I dont have one. I am 33 years old and my fiance and I have one child together. Its not like I have alot of things to "WILL" to anyone, but I want to be sure of the custody of my son. Is this taken care of in a will? I am no expert, and am only 23 years old, but I am going to have a will
made up for myself. It will give me peace of mind to know that there won't
be any disputes over my things, should I pass. I have had quite a few
family members die, and things can get pretty ugly when it comes to money
or property of those who have passed on. People, even family, can be very
mean and petty. I do not want my loved ones to have to deal with any of
that. A will is a good thing to have around anyway. Especially for me,
since I want to make sure my deadbeat father never sees one red cent. =}

Yes, custody and guardianship are specified in a will, as is asset
distribution and burial specifications. I had a Last Will and Testament
and a Living Will drawn up with a local attorney for about $200. There are
books and computer programs that show you how to prepare a Will yourself,
but I wanted to be sure that all state requirements were met so I did it
through an attorney.

Also include something called a living revolkable trust, this will ensure
that things such as custody of children is taken care of . Sometimes a
living will is not enough when it comes to the state laws.
