Is this grounds for a discrimination suit?

I was denied surgery based on a written exclusion which I was planning to appeal knowing that I probably would not be successful.In getting my appeal together I went to the BCBSTX website to find the correct address and noticed a list of topics on keeping healthcare affordable under that was a subtopic titled "eat responsibly"and it suggests that health care can be more affordable if we control obesity and its health related costs by making responsible eating choices. I was appalled that BCBS would be so insensitive and would have the nerve to put that on their website. However I feel that this may provide a grounds for having the exclusion removed. What do you all think? Ive already written a nice little letter to the customer service department and used terms such as insensitive,discriminatory,derogatory media attention and law suit. Am I on the right track here?
