My insurance company refuses to do any precertification at all. Is this legal?

My insurance refuses to give a pre certification to the hospital of any kind. The said they wont even review it until the surgery has already been done. But, the hospital wont schedual the surgery without this precert, they want 25,000 in advance and I cant pay. What do i do now??
