Denial...do I get Walter Lindstrom to fight insurance co. OR my employer???

How do I know if the insurance company is denying me ("policy exclusion") or is it really my employer? If I want to hire an atty. to fight this, who does the atty. appeal to, my insurance company or my employer? Should I go directly to my employer myself, and if so, what should I say?
