Has anyone appealed the BS of CA 6 month waiting period?

My friend didn't have insurance prior to going to work for my husband last October. Her insurance became effective Feb. 1, 2003. She was approved for insurance but then they came back and said she had to wait for 6 months from 2-1-03 because of a no prior insurance exclusion. She has appealed just in case but has anyone had an luck with similar circumstances?
