It's still in clinical Trial right? Lap Band

My insurance bc/bs carefirst has an exculsion policy in my poicy that says" medical or surgical treatment of obesity,UNLESS OTHERWISE SPECIFIED IN COVERED SERVICES. in the covered services part it states that CONTROLLED CLINICAL TRIALS ARE COVERED AS LONG AS THEY ARE FDA OR N.I.H OR DEPART. OF VET AFFAIR. OR DEPT OF DEFENSE. APPROVED. Now Iam having the Adjustable Lap band done and have been denied once and am fighting it. does this sound like i should approach the fight this way? Should I have my surgeon redo my letter stating this is a fda clinical trial I've been asked to participate in? HELP!!!!!!!!!!!!
