How do you get a self-pay insurance to pay for WLS?

My DH has a self-pay ins plan that basically means that the guys that run his union pick out what is covered and what is not. I recently appealed and was denied because they didn't want to cover it because someone they knew died from the procedure. When I did research about how legal this was, I found out that because it is considered a "self-pay" plan they can deny anything they want. Is there any way I can get them to pay? I have come far to make this decision and don't think I can just walk away. Any suggestions would be helpful! =D
