have not lost weight in 3 yrs could my and have malfunctioned

hi I got my surgery 3 yrs ago and I really havent lost a lot ofweight I am around my pre surgery weight and it is killing me is it just my poor choices or did the band malfunction my doc does not believe in giving fills at every visit I think I have had a total of 5 fills I do sometimes drink when I eat so that is his reasoning for no fills
