Can my Boss do this?

I went for consult on 1-9-03, returned to work on 1-12-03 and told my co-workers about my plans to have surgery, most were very excited for me but not my boss, he came in my office after lunch and told me he was taking me off full time and putting me back on part time, and that I would be losing my benefits, Can he really do this, isn't that discrimination?
