Does anyone have Beechstreet ppo of Texas and how long til approval?

My real question is my husbands insurance was the only insurance I had in 2001. I have been fighting them since September 28. It came down to his company had a exclusion. Long story short his company is allowing a one time exception so I am approved.They did not tell me until Jan 21, 2002 But I took my insurance because they do cover the surgery. But I was told my ins. would be primary this year and I have to wait for them to approve me. Why is this so if this took place last year and they held out and approved me this year. Is this legal?
