Welcome to the LW board! I was just under a 40 BMI and had osteo arthritis in my big toe knuckle - and that got me approved, but I had a different insurance...

I think Diabetes and Sleep Apnea are the only sure co-morbidities. I've never heard of an insurance company rejecting people with those
A lot of insurance companies only count HBP if it's not well controlled with medicine. (Which I think sucks.) Most count your weight the day you go for your surgery consult, but some don't want you to drop below their minimum BMI at any point even though they also want you to do some sort of supervised diet. (Which also sucks.)
Be sure to drink a lot of water and wear heavy clothes to your consult. No sense ripping yourself off a pound or two from what you often weigh.
