Anyone have a problem with

their insurance restriction of 5 years of a bmi over 40? I am having this problem, I am now 42 bmi with sleep apnea but the past years have been between 37-39 with no recorded comort.'s. Has anyone had luck fighting this with their insurance? Kitty Dam healthnet HMO

I'm sorry to hear it....I ran into the same problem and the 5 year bmi is what ultimately caused the insurance to deny coverage....i also have sleep apnea....you would think they would rather fork out the money for the suregery than to deal with all of the upcoming medical issues.  After going back and forth with the ins. co. for about 6 months I decided to finance the surgery.  I'm glad I did because I am already feeling so much better (2.5 months post op and down 57 pounds)!  I don't sleep with my mask anymore and I'm getting a good nights sleep.  I used to fall asleep at my desk..couldn't keep my eyes open...but I feel so much better now....Good luck to you!

I have.  Not easy.  I think my cir****tance was rare.  For some act of God, I only had one single document on my 4th and 5th oldest years.  I claimed the one document was noted wrong and the reasons why it can be disputed.    If you have a lot of medical records within that time frame you will have a very very difficult time.  The only thing you can possibly do is say you cannot obtain them and all efforts have been exhausted.  If you have had the same insurance the entire time, I fear you will have to hire an attorney and your chances are very slim...but still possible.
