Fired because of WLS....

I work (well, used to work) at a special school for kids who have been kicked out of their regular schools due to psychological and behavioral problems.  At our school we have to be certified in this restraining technique called Handle With Care.  Well, I've been off work for some time and was scheduled to go back tomorrow...but my Dr had sent a note saying I couldn't be trained in the restraint technique for another month (it's a very physical thing)....well, they called me today and said that they can't have me working in the class without being trained....and they can't wait another month for me to get trained.  All of this after I've already worked there for 4 months without being trained before surgery!!!!  What the hell!?!?!  So yeah, now I need to find a new job.  They said I could come back and re-apply for a job if one is available after I am able to do the training, but I am kind of pissed right now...so I don't know if I will do that.   Anyway, just wanted to vent....I'm feeling like they are holding my surgery against me when it's not my fault... Girl that sucks!! I would seriously call a lawyer and ask about that.  They can't hold that against you.  Did you fill out any FMLA paperwork for your surgery?  If you did, they can't hold it against you.

I agree, it won't cost you anything just to call a labor attorney, sounds fishey, they should have been able to accomodate you I would think...In the meantime, keep your chin up, maybe this will lead you to something bigger and better!

Umm I don't think it is legal at all for anyone to be fired, if a Dr.s note is present. Call a lawyer like the others have said!

I'm gonna give you opposite advice, just to be different.  But this is truly how I feel, too.  Just be happy to be gone.  These people are obviously not WLS friendly.  Just be glad to be gone.

Well.. you could look into fighting it - but would you want to work there anyways? Whomever is the top person there.. make sure they know whats going on - possibly a decision was made without them? Was HR involved in them telling you this??  They really cannot just let you go if you are medically unable to perform a task. You could look at it like a paid vacation thou... collect unemployment and take some time off :-)

First visit to surgeon - 288 ~ bmi 45.1
2 week pre-op 252 ~ bmi 39.5
Total lost - 153 Since surgery - 117!
Goal weight - 155 (mine) 180 (surgeons)
Current weight - 135 (2020 I lost 10lbs due to dedicating myself to working out more and being in better shape)

1/14/2025 still maintaining 135 :-)

Hey, yeah I'm not sure if I'm going to fight it at all because I don't really want to work there anyways if they are going to be like that.  I guess I am just happy to be gone....now the only problem is INSURANCE...ahhh....I guess I need to be finding a new job really quick!!!!   Hopefully this will lead to bigger and better things!

Hey if you don't want to work there cool. But forget unemployment. Sue them for unjust termination! Get some money out of it, and collect unemployment!

I used to have a friend that was an attorney. I learned a few things you could say!

Oh that sucks and I really think I would be making some phone calls.  Just doesnt sound like something they can do with you having worked there already.  I could understand if you had not started work yet but come on 4 months and NOW the class is a must have!  I am not the get a lawyer type but I probably would be on this one!
