Mary, I believe that if residential property is converted to rental, the rules regarding the section 121 exclusion are different depending upon whether the conversion takes place after the last date on which the owner occupies the property or beforehand. If the non-residential use takes place before the last day that property is occupied by the owner then a portion of the gain is eligible for exclusion. Example: Jen rents a property for three years, then lives in it for two years before selling it. Jen would be eligible for the the section 121 exclusion because she owned and occupied it as her main house for 2 years out the 5 year testing period. However, only 40% of her gain would be eligible for the exclusion (which could still be $250,000 depending upon the gain amount).

The rules are different if the rental occurs at the end of the ownership. If, instead, Jen owned and occupied her house for two years and then rented it for three years (still meeting the 2 of 5 test of section 121), she would not have to prorate her gain. Instead she would only be taxed on the depreciation recapture. There is a good worksheet on this in the Publication 523. I believe that the tax policy reason for this is to make it easier for people to move if they cannot sell their house and need to relocate for work or personal reasons.

Cheapskate (I believe that you are a Lisa - excuse me for not knowing) IRS Publication 523 has a good summary of how to calculate adjusted basis and gain on property sales. If you want to go deeper IRS publication 551 has more information on basis.

Tri****hink that I know my travel schedule a little better for the convention. I will not be traveling to Texas right afterwards, so probably will go home on Sunday. Most likely I will book my travel the first week of April. Marilyn has a reservation at Vaca during her tennis tournament and will report back to me.

The plan today is to finish for early, go to 5:30 Crossfit and devote the evening to Corned Beef and the NCAA tournament. I will care intensely about the tournament until Saturday when I go see my son and then will lose all interest until the final game in a couple of weeks.

ok this is interesting news about the property info. we may think on renting for the rest of period on this house then before selling. will have to think on that. we are having to claim capital gains tax on the TN house we sold last year also so I'm not sure what that will bring.

I have to take my mother to a tax appt this morning (the AARP tax clinic), but this year, instead of sitting there while the volunteer does your taxes, they want us to just drop off the documents - stick around for a few minutes in case the person has any questions - and leave. They'll call later in the day or tomorrow when the returns are ready to review and sign. So..hopefully we'll only be there for a half hour or so, because after that I have to pick up MIL so we can go out to one of the ex-burbs for a brunch and film viewing for our documentary film group. Then I'm hoping to get back home by 1:30 so I can watch the livestream of the Chandler Halderson sentencing hearing (he's the one I was talking about a couple of months ago - a young man in the area who murdered and dismembered his parents last summer - the trial was livestreamed to several sites, and I was absolutely glued to it). The sentencing hearing is being livestreamed to youtube (among other places), so I would imagine it'll be recorded there so I'll be able to see if I happen to be late getting home. At least I hope so... Then I'll probably have to take my mother back to the senior center to review and sign her returns sometime this afternoon, too.

yesterday's visit to the Alzheimer's Research lab went well, and I biked for 90 minutes yesterday afternoon. My weight is still up this morning (not that I was expecting it to budge much after one day - and yesterday was another high-sodium day to boot, so I'm feeling very waterlogged this morning). I have a lunch scheduled for tomorrow with a friend, but I'm thinking of pushing it off until next week. Between all the eating-away-from-home I've been doing this week - plus the brunch this morning and another lunch on Saturday (to celebrate my late father's birthday with my family), the last thing I need is one more restaurant meal. I wish I had the resolve i did the first couple of years post-op when I could manage these things. I had no problem working them into my plan - but I seem to have lost that ability. So it's either get back to it (easier said than done), or really limit these engagements (and just focus on not making a pig of myself). It's really not an issue if I'm just going out a couple of times a month, but these weeks when I have three or four eating events - ugh. Big problem. So anyway, yes - I may just reschedule with my friend.

Happy St. Patrick's Day. I have siblings and cousins who started celebrating at 5:00 AM with eggs, Irish sausages, soda bread, and green beer to wa**** down. The green beer will flow, there will be corned beef, cabbage, potatoes and tables of cakes and pies. There will be plenty of Irish music, dancing, hugging, and toasts like, "May your wife and sweetheart love you, and may the two never meet".

My sister has a pub in North Carolina and it was two years ago that the police shut down their St. Patrick's Day celebration at 3:00 PM and sent everyone home due to COVID.

As a non-drinker, I still attended the parties every year. I loved the people, the food, the music and dancing and was appreciated for driving people home. I would not even dream of attending now with the risks of COVID, but have great memories.

I know Chrissy will get great care. I can never sleep the night before surgery, but figure I will do plenty of catch up on sleep in the hospital. Hope her recovery is quick and easy.

QJB I hope things settle down and are resolved soon. You are wise to watch the scale. Stress can make weight come on like magic and not good magic. The times when I just wanted to forget the scale were the times when I would see seven pounds of gain when I finally got myself on it. I never miss a day of weighing myself and don't tell myself that I am fine without it.

Good morning ~Happy St. Patrick's Day! Lousy day yesterday. I had a really upset stomach so I went home early from work. I ate saltines and had zero 7-up which seemed to help and fell asleep. I woke up dizzy and burning up in total RH the worst I've ever felt - so scary. I was so out of it I could even think to eat some sugar so I rode out the whole thing without. I'm still shaky and have a horrible headache today but at least it's over. I'm working from home.

QOTD - A work in progress - ever evolving. I'm still trying to figure that out

Food is up in the air but I do know we are having corned beef Rueben's for dinner and watching The Quiet Man while wearing green. Cheers!

Good morning and Happy St. Paddy's day my friends. For those who don't know, my last name is McGinnis -- so this is me today!

I did really well on food/calories yesterday. By Mid day, I decided that what I needed more in the world than anything was a fried egg sandwich. I have not have one since pre surgery. So (lucky me!) I had picked up TJ's new egg white wraps this weekend and I heated it and then folded it in half. On that, I built a great piece of cheddar, some tomatoes, a tiny bit of mayo, a slice of bacon and a perfect, fresh from my friends chicken coop fried egg. Wrapped it up half burrito/half taco style and LOVED it. Couldn't fini**** all, but damn it hit the mark. Oh, and work nearly killed me again yesterday and looking for more of the same today. So blessed to have so much.

QoTD: I am a good person. Of my group, my community and my world. I try to make decisions that will leave this place better for my kids and grand girls. (also, I am an ADD adult and that is my super power!)
