Got my date, but employer will not approve time off
I checked the Department of Labor website to make sure the rules had not changed. I'm really not trying to argue with you, I just wanted to make sure I was giving people correct information.
From the Dept. of Labor website:
"Employees are eligible for leave if they have worked for their employer at least 12 months, at least 1,250 hours over the past 12 months, and work at a location where the company employs 50 or more employees within 75 miles. Whether an employee has worked the minimum 1,250 hours of service is determined according to FLSA principles for determining compensable hours or work."

Contact your surgeons office and explain your situation. Believe me they want you to have the surgery more than you think it might take a little longer of a wait and I can understand your anxious and excited to finally have a date but it is not worth losing your job over. They deal with this all the time and even offer to be willing to take a opening if someone has to cancel or postpone their procedure that way you might have a better chance at getting a date sooner than you think and will be able to get the time off that you need. Dates can and are changed all the time. Dont worry you'll get what you need. Best wishes and sending blessings you way.
I know my employer (I'm in RI) has a 90 day probationary period and I had a co-worker who was admitted to the hospital 2 weeks shy of the 90 day period and on the day she was admitted she received a certified letter terminating her.

I thought I was covered by FMLA at my job when I had my son, but I would of only been there 11 months when I had him so I didn't qualify What makes it worse is that I didn't even make it til my due date working, I had to put in my notice at 9 months. Just check and see what policies you have at work that could cover you. My best situation was putting in my 2-weeks and leaving on good terms so I was rehire-able when I was ready to come back. Good luck and definitely see what your surgeon can do for you. Maybe plan it once you're out of your probationary period!
