I wish.  But (1) I'm not licensed in your state; (2) I'm not a litigator; and (3) I'm not an insurance lawyer.  But please contact a medical malpractice attorney in your area -- remember, this cause of action doesn't even REQUIRE malpractice -- it is an ethical violation regarding informed consent and other torts.
