Legal ramifications of denying a TB test?
Hey there Mamas,
I would love your input/experience on this one.
I work in the public school system and received notification that my TB test needs to be updated before the end of February. If I do not have the test performed, they say they will hold my pay until it is done.
I am currently over 16 weeks pregnant and after reseraching, I am not comfortable submitting to the test. I am pretty opposed to any interventions or tests that are not medically neccesary.
Have any of you had experience with this?
Thanks!
**Wow! That was so easy! The head of HR said that he would not have a problem waiting at all! SO not what I expected, but so happy to have the support!**

You may be able to get a doctors note indicating that becuause you do not travel, have never had a positive read etc... and based on all the documentation your risk for TB falls below the risk category. They may take that, but take it directly the Manager of HR.
I used to work in a hospital with the same restrictions, and basically it is a condition of employment, they can let you go for not complying. But usually that letter will work.
Good luck!

I would do what the girl above said ... It's also possible that you can get it checked with an xray. I know that they can drape your stomach with a lead apron to protect the baby if necessary.... but I'm not sure if they could see all of your lungs that way... or if that's worth the risk. Being pregnant is considered equal to a disability by the federal government, you may need to remind them of that.

Good luck with that. I hope you can find a way around it.
I agree with the previous poster about getting the doc to sign off.
Not quite the same...but my son's school sent a note home saying that if I didn't obtain a 2nd dose of a vaccine by the 19th of January, he would not be allowed to attend class.
Really ticked me off since this is a new requirement for this school year and they already hit me up with it right before school started...didn't bother to tell me then that it required a 2nd dose...jerks!
Again, good luck. Stick to your guns :-)
