Define Malpractice?
If your surgeon new he made a mistake but had know other choice during the procedure in operating room so he did the next best thing but now things got worst but his correcting the problem, are u suppose to do anything or does things happen human error? now that im missing work due to this unexpected occurrence is he suppose to compensate me for loss of wages or pain and suffering? or is this all just part of the risk you take with plastic surgery??
Usually when you sign the consent for surgery, the possible problems are listed and discussed.
Malpractice is when a doctor acts in a negligent way or an unethical way. Things happen, complications happen with every surgery. Sometimes, there is no rhyme or reason for a complication, it's the risk you take when you have a procedure done.
Of course, many attorneys will try to tell you that they can sue for most anything - they think doctors' and their malpractice insurance have deep pockets.
Having elective surgery or any surgery for that matter, it should be understood that risks can and often do happen. Did your doctor act in a way that was against "standard practice?" In other words, if any other prudent surgeon was in the OR with your case, would they have done the same?
