Ok I know someone has some good advice for this question pls help

Ok ha arm life had complications went back in hospital to make long story short, was discharged with a wound vac, of course cant go back to work like this in the field im in, so i already last a weeks pay and coming up on two, now im suppose to be covered under some plastic surgery insurance so supposely there picking up the cost for hospital and dr also is doing what he has to do as well so in dont recieve any bills wound vac also getting home health which was approved threw workmens comp how is that possible when it wasnt work related is there some other kind of workmens comp for plastic surgery? thats my first question and second since im losing all this time off work is there something i can file? or do i ask my drs office, until i can return to work looks like  i will have this wound vac on for a few weeks., now i no human error happens things happen the dr is doing his best to correct problem he opened up a claim so what does all this mean? everyone keeps asking are u gonna sue of course not as long as dr is correcting the problem why should i, but in know there has to be something covered some where if your losing time from work?

Did you apply for Short term disability? I know that before my surgery I signed pages and pages of waivers that protect Surgeons from lawsuits. I am dealing with a complication as well but knew in advance that  there are no guarantees  in plastics,  we're not cars. Every outcome is different. You might qualify for FMLA but it's possible that you would have needed to started that paperwork before your surgery., This will not pay you but will protect your job position.  Have you talked to your HR rep?

Ok thanks.. Actually yes he cut to much skin and he didnt want to make it to tight cause it would have caused more problems he said, he actually estimated his cut.. he said first he did the lipo first arm swolled up and then he cut to much that why he was able to have the other arm come out perfect cause he saw what went wrong with the first arm so actually when he made two incisions on the arm apparently it wasnt enough skin or something that the stitches just couldn't handle and busted open. and no i work threw a home health agency on your own they dont offer all that .. but i do no exactly what your talking about thats what i did when i worked for coca cola i had all the benefits.. will hopefully the cosmetic assure some insurance that covers procedures that are done in thirty days your still covered.. so well see whats happens there.. thanks for your reply. but ive also been told it doenst matter dr still made mistake and i can be compensated for that as far as losing time off work . Because im sure he doesnt want things to go any further.. i dont no wasnt expecting all this to happen.. he should have not un estimated his cut.

Was it something the surgeon did deliberately?  Did he make the incision too tight - were you compliant with all of his instructions?  All these things will be asked.  Do you remember discussing possible complications related to your type of procedure?  If you signed the consent and agreed to understanding your procedure and the complications, you take full responsibility for the risk.  Your doctor is extremely nice if he's going to pay for your wound vac and for the care you are receiving.  I would venture to guess, getting FMLA is your best bet for keeping your job safe for 12 weeks.  After 12 weeks, FMLA won't cover your job security.  Do you pay or get Short Term Disability from your employer?  I receive STD and I pay for Long Term disability should anything like this happen.  The plastic surgery insurance company should be able to help you with understanding how you are covered.  Call you HR and ask them about getting FMLA asap, so they will hold your job for 12 weeks at least.

By all means im not trying to do any suing im just trying to fiqure out i cant go back to work with this wound vac so in the meantime can he cover loss of wages isnt that in the costmetic insurance cause i have to have this on for at least three weeks..

Contact your cosmetic insurance company and discuss your loss of wages with them.  It's not the doctor's responsiblity.  You would have to sue him for malpractice to obtain support of that kind.  But it would have to be documented malpractice.
