legal advice please...

Hi, I had a supposedly reputable contractor build me a garage with concrete slab, and roof my home about 3 yrs ago. I was so dissatisfied with his work cuz I had to have someone correct some of his errors that I held back $3,000 of the total bill which was 13,000. I initially seen an atty because this guy was harrassing me and I decided at the time to let it slide and just be rid of him. I've put up with the concrete slab that was not slanted enough to le****er run off, and my garage siding does not match my home (yellow to green) and now I found out that my roof was not applied properly and have shingles sliding off my roof. I know it'll be a big hassle but should I go after him legally?
I already downloaded a complaint to my states consumer affairs dept.
How do I stand legally...I won't hold anyone to this just want to know if the effort will be worthwhile. I do not want him to correct this tho.
Any info would be great....

Alice,  Sorry, I don't know much about what to do.  Did you get references before you hired the contractor?  What does the contract say?   I'm guessing that the contractor must live up to the state contractor requirements and to the contract.   Even if you have a great case, it can be a big pain for sure.  I hope you will be able to get it resolved, sorry I can't be much help.

 *~*~*~*~*~*~*~~*   Only thing I can think of is:  You paid $13,000 for the work done.  Did you get a $13,000 job?    He agreed to do this job for $13,000  Did he keep his end of the agreement?  Lawyers are legal mediators when two people don't agree on something.  I would recommend talking with a lawyer to see if and what can be done.  No, I wouldn't want him near my property again either.   It will be a hassle going after him but it is a hassle putting up with shoddy work too.  Good luck with your decision.  Millie

You cannot withold the 3,000 dollars because he can get a lean against your house.  So, pay him the money, then hire an attorney and sue him for the improper job.

Thanks for your help. Initially I was told by that atty at the consultation that since the contract was illegal to start with he would not be able to put a lien on my home.
Well, I guess I know I have to see that atty again so I better make some calls.
I will not call that contractor unless advised by legal to do so.
I did call some of the references but I believe they were hand picked and they were all women that I'm sure didn't know the difference at the time between good and bad work.
I had a lengthy bid process and did my homework but it wasn't enough aparantly.
