WELL THE SH*T HAS FINALLY HIT THE FAN HERE....
Judy, maybe I misunderstood a while back, but wasn't part of your husband's problems his mental faculties and would that have been the reason you had power of attorney to begin with? Well, how could his daughter get power of attorney from him if his faculties are impaired. First, don't you have to be of sound mind to give it? I would find out how she managed to pull this off. If it was secret, then he would have signed anything she told him to sign and then got it notarized. Maybe even the notary was her friend and with her at the time. If this is the case, the POA may not even be valid. I would certainly make that be a big issue when you see your attorney. If the POA is not valid, then everything else is moot at this point. As for the "divorce," I agree with others, that could be just a rumor. But at any point, you have not initiated anything yet, so you are still legally married to him. Hang in there.
I DON'T KNOW HOW THEY DID IT EITHER WITH HIM NOT IN HIS RIGHT MIND.....I HAVE TO WORK TOMORROW 8-2 THEN I AM GOING TO CALL MY LAWYER WHEN I GET HOME SEE WHAT HE HAS TO SAY ABOUT ALL THIS!!!! I AM SURE THE THERAPIST HAD ALOT TO DO WITH IT....SO MUCH FOR TRUSTING HER TO HELP ME WITH HIM.....
THANKS FOR EVERYTHING THO....HUGS
Judy I am a Notary and we do not judge the competence of someone....we only notarize that it is them signing the paper in my prescence........You should talk to an attorney BEFORE you ever deal with his daughter.....and if she will benefit from any proceeds from him.....you should definitely talk to an attorney......
I also would NOT count on any money from a lawsuit for another year or so.....they string things out as much as possible.....My mother was walking down a street and someone's dog got loose and ran out and chased her and bit her leg so badly that part of the back of her leg was gone......she only received $15,000 for her injury and it was a permanent injury...and the lawyer took $5,000......my brother had been so upset he insisted on suing the owner.
Hugs, Marti

Cover your cheeks darlin! I'll be sure to check back to see what's happening!
Love ya!
Judy
Judy,
I think it is absolutely deplorable what your step daughter has done! I know each state has different laws, but I really cannot see how she was able to obtain a POA especially considering Gary's state of mind at this time.
I know things eventually are going to break for you and you will be able to start enjoing your life to the fullest.
