Obesity falls under pre-existing condition

Hello everyone I recieved a letter saying that I couldnt get coverage because obesity is a pre-existing condition that was not covered under a prior insurance. Therefore I will have to wait 12 consecutive months for my insurance company (Performax PHCS) PPO to cover it. I have had this insurance since last november, almost 9 months. Anyone with the same insurance having the same problem?

Any update on your situation???
