I just thought I'd post my opinion and experience with all the denials now claiming the band is experimental. Because as you know it is FDA approved and the research pre-dates even the RNY. A few years ago when the RNY was popular many carriers decided to only cover it if it was done open. Why? Because most people were scared or apprehensive over the open procedure and that's why laparascopic RNY appealed to them. But covering only the open was a way to scare patients away from the RNY. Some surgeons, like my own said they just would not do the RNY if it was forced to be done open. Now, because the band is popular, there are many companies that cover the RNY but will not cover the band. Hence, the same problem. They know the band appeals to people due to it being reversable and fewer complications, so they want to scare you away by saying get the full bypass or nothing at all. Guess what. Don't back down. and good luck Gary viscio obesitylawyers.com

Gary; Thanks for the FYI; I have several months of stuff to complete before I can even send in my packet. When I get my denial, and I will I'll be in touch with your office. The support meeting I went to yesterday; The MD was referring to the Lap Band as Gastric Bypass.........hmm some food for thought, even though it is only a restrictive, that's what the RNY is too besides being Mal apsorptive procedure. It still all about words! and you Lawyers are best with words! Gail
