Has anyone ever had this happen to them? The nsurance company person told me that the first person that approved the claim made a mistake. Do you think the lawyer will win my appeal based on their mistake thats not my fault. I started this journey in FEb. 2004 and am still waiting.

Did you get it in writing that it was approved? Contact Gary and ask him what he thinks. http://www.obesitylawyers.com/

Capital Blue Cross that I have only gives oral approvals, but the weight loss clinic has the conversation with the ins. lady on tape, so that is a plus!

Good gosh...this is de javu...that just happened to me. Sounds like my cir****tances were different but the result was the same. When our insurance renewed at my office, we had to change from the HMO plan to the PPO plan because of the rate hike. Aetna moved me over to the PPO but failed to remove me from the HMO plan. So when I had a doctor's appointment, I showed up as an HMO client. When the approval came through under the HMO plan. On the day that I was informed I was approved, our office bookkeeper discovered Aetna's error. The error was buried for a couple of months because Aetna had our billing all messed up. The error was corrected and within 30 minutes after being informed that I was approved, I was notified that I was now denied because the PPO plan does not cover the surgery. I sent in an appeal but I was just informed that it was denied. I contacted Gary' V through his web site but he said in spite of the many errors that Aetna made, the bottom line is that I was in a plan that didn't cover the surgery. You can't argue with that...and Aetna didn't ...they just denied me. Now I am looking at just how much it would cost to do a self pay. I have to have this surgery. Good luck to you Donna
