PLEASE HELP! SECONDARY APPROVED ONLY IF PRIMARY IS DROPPED!

NewStart lady called, she said my predetermination letter was approved by my secondary insurance BUT they would only cover if my primary covers. My primary has a direct exclusion, so in effect- I have to "get rid" of my free insurance thru my work. Q#1- Is is legal to "decline" coverage? It feels like insurance fraud somehow... Q#2- Any idea on waiting period when secondary finds out they are now the only ones? Q#3- Even though there is a direct exclusion, should I wait for the benefit of the doubt on the primary before cancelling?(probably months) Q#4- Would it push the issue to ask the covering insurance and tell them I am "going part-time and 'loosing benefits' and soon they will be the primary? PLEASE HELP, OR SHOOT ME!!! I will be up till 2 am worrying about what to do, so please any info/ideas? I am about to approach the boss and ask to be cancelled this week, is this a mistake? thanks Deb B

Is your secondary insurance thru your spouses insurance? If it is, I would personally quit my job if I had to in order to have WLS. Having WLS is the best decision, bar none, that I have ever made for myself. So many people have had to self pay, go to Brazil or Mexico, or just go without. Does your spouse have to pay for your secondary insurance, or is it free? I'm not an attorney (and I don't play one on TV) so I can't advise you legally as to what constitutes insurance fraud. Another thought is to call the Insurance Commissioner in your state, and run this by someone who can advise you. Good luck. I hope you'll be a loser soon.
