Uniform Medical Plan WA state denial upheld.

I'm so discouraged. I've been fighting what I thought was the good fight since May 2004. I've been fighting an exclusion policy, but was told that there was a medical necessity clause. Now today they say there is not one. I've been denied twice. I filed an Independent Review appeal and just got word yesterday that they were upholding Uniform Medical's exlusion policy. I am super morbidly obese, high bp, hgi chol, sleep apnea, low thyroid, bi lateral knee replacements, breathing difficulties, rest less legs. They will pay to replace my knees at $80,000 but not this life saving proceedure. Am I just out of luck? I don't have a lot of money for a lawsuit. It just makes me so angry! I know of two people in WA state who had this surgery in 2003 even tho the company denies it has ever approved it. Also if I end up self paying I'm scared to death of complications. Uniform says they won't cover complications either. I can't risk our entire future. Are there any supplemental policies coving "catastrophic complications" that I could take out prior to surgery? Any suggestions or input gladly appreciated. I just thought if I did everything right that it would work out. Wrong. . . .

What does your insurance book say? Do you have this in writing that it has a medical necessity clause? I got it in writing that they coverd WLS. Donna
