DENIALS AND APPEALS
HELLO EVERYONE,
I HIRED AN ATTORNEY TO HELP FILE AN APPEAL ON MY BEHALF. THIS TURNED OUT TO BE A MISTAKE. IN MY TRYING TO DECODE ALL OF THE PAPERWORK I FOUND THAT I COULD HAVE HIRED ROBERTA. SHE ANSWERS SO MANY OF OUR QUESTIONS AND OFFERS ADVICE. I HAD NO IDEA HER WORK WOULD BE AS EFFECTIVE IF NOT MORE SO THAN THE ATTORNEYS LONG WINDED NOT APPLICABLE " PIECE OF AN APPEAL" LOL!
IN MY OPINION THIS WOULD HAVE BEEN A BETTER ROUTE FOR ME AS SHE WOULD HAVE TOLD ME RIGHT OFF THE BAT THAT I HAD NO CAUSE OF ACTION AND JUST SIT TIGHT AND DO MY 12 MONTHS OF DIET AND EXCERSISE.
I HOPE THIS HELPS ANYONE STRUGGLING WITH THE SAME DILEMA. TO HIRE AN ATTORNEY, OR NOT TO HIRE AN ATTORNEY!

I went the attorney route. We tried on our own first. I used someone who is around here alot. He sent out an appeal. Received a denial which is the same thing that happened with us. But he went right on with speaking with their next level appeal person, in this case it was an attorney because my company stinks. They say it's excluded no matter what. But, my lawyer (Gary) got the lawyer on the phone and lawyers speak like lawyers and after a few weeks he got them to lift the exclusion for my situation. I hnestly believe that because he was able to open a dialogue with them he was able to help.
I think it all depends on the situation. I know many people who did it on their own, and some who have not. I know from a post he made he has gone so far as to tape record conversations and use it against them. And I know there are other lawyers out there who fight as hard also.

Some states require two party consent, some states only require that one party knows the call is being recorded. You should check the laws of your state and if legal, record the call when dealing with your carrier. Just make that if the carrier's office is in another State you know that law as well.
