Does anyone know the answer to this? If you are just starting on a new plan and they say that they dont pay for pre existing conditions for up to 12 months, is there a way to get around it if you really need this surgery?

Jamie, Unfortunately, this is a difficult thing to overcome unless you had no break in coverage. If you had insurance prior to this new policy, you should not have a waiting period. I know that we have helped patients to overcome this clause if you get a statement from your previous carrier showing that there was no break in coverage. Good luck. It's a tough situation. True, if there is no gap in coverage you would have to wait. But, there is a grey area as to whether treatment of lets say diabetes is treatment for obesity. Many states recognize this. In other words seeing a surgeon for WLS may not be considered something that is pre-existing. Gary Viscio obesitylawyers.com
