When I first called my insurer about WLS coverage, I was read an exclusion that is supposed to be in the policy. When I asked for a copy of this exclusion to see for myself, I was told "oh, we don't send out that type of information." Can they legally refuse my request??? Any help will be appreciated.

They absolute do have to provide you information regarding your coverage. (I hope you got that person's name that told you that). I was told by my insurance that I had to request the information in writing (which was fine...added to my paper trail and I didn't want someone to tell me over the phone anyhow, I wanted their requirements/exclusions in writing). I wrote a nice letter requesting ALL information in my policy regarding requirements for bariatric surgery (my insurance doesn't exclude). I mailed it certified, return receipt so I know when they received it. It took about three weeks to receive the information. Once in hand, it was very insightful. So you might want to try sending in a written request to your insurance company. I have never heard of an insurance that refused to disclose information regarding your policy. Let them refuse to disclose in writing...which I bet they won't. The person you got on the phone probably just didn't want to deal with you or your request. If they write you back and still refuse, seek and attorney. You have a right to the information in your policy, especially if they are using it to deny coverage.

Absolutely not. You are entitled to a copy of your Summary Plan Description or your policy if you are fully insured. You don't want piece meal pages - you want the entire document.
Call the Insurance Commissioner's office in your state. If you are under a self insured plan, they will give you the contact information for you to call the Dept of Labor.
Either way, file a complaint, and you will be surprised just how quickly you get the document sent to you.
