So many say that if an insurance plan has an exclusion against obesity that it is not discrimination- it is just the plan that my employer chose. Here is my question- my plan also has an exclusion that they will not cover cosmetic surgeries that alters the appearance of the face, neck, breast..... Since my plan has an exlusion against obesity and they denied me for wls, wouldn't it be discrimination if they approved for a co-worker to have a breast reduction? Their reasoning behind approving the breast reduction was because it was medically necessary. Please share your thoughts. Thank you! Beth M

You don't want to hear this, but it's not discrimination just because they paid for a medically necessary breast reduction. I personally believe that an exclusion for treatment of morbid obesity is DISCRIMINATION, on it's own merits. What other disease is excluded from treatment? None. The problem is that most of society feels that obesity is character flaw, and that we are weak, slovenly, parasites. I find this very ironic, considering the percentage of overweight Americans in our society. The only thing that will change this, is changing the laws. Write your senators and let them know how you feel. ERISA SUCKS. It just protects the employers, not the people who need protection. OK. Stepping off my soap box...

I just needed to hear the truth. I guess they have proven that they can exclude exclusions though if they want to. I hope that you are having a wonderful Sunday. Beth M
